Terms and Conditions

These Terms and Conditions ("Agreement") govern the services provided by SunKiss Auto Spa ("Company," "we," or "us") to you ("Client," "customer," or "you"). By booking our services, you agree to the terms outlined below. If you do not agree, you must refrain from using our services.

 

1. Services Provided

SunKiss Auto Spa offers mobile auto detailing services and in-house ceramic coating services. The specific services provided will be outlined in the booking confirmation or service agreement.

 

2. Payment Terms

  • Payment is required in full upon completion of the service unless prior arrangements are made.

  • Deposits for ceramic coating services may be required at the time of booking.

  • Failure to pay in full may result in legal action, and the Client will be responsible for any associated fees, including collection costs and attorney fees.

 

3. Cancellation and Rescheduling

  • Cancellations must be made at least 24 hours in advance. Cancellations within 24 hours may be subject to a fee of up to 50% of the scheduled service cost.

  • Rescheduling is permitted but may be subject to availability. Repeated rescheduling may incur additional fees.

4. Liability and Disclaimer

  4.1 Vehicle Condition

  • SunKiss Auto Spa is not liable for pre-existing conditions, including but not limited to scratches, dents, paint defects, upholstery stains, or mechanical issues.

  • Customers are required to disclose any known issues with their vehicles prior to service.

  4.2 Damage During Service

  • We take all reasonable precautions to avoid damage; however, we are not responsible for damages resulting from:

    • Pre-existing issues or weaknesses in the vehicle.

    • Poorly maintained paint, trim, or upholstery.

    • Manufacturer defects or improper repairs.

  • In the unlikely event of accidental damage caused by our team, SunKiss Auto Spa will evaluate the issue and provide a resolution at our discretion.

  4.3 Ceramic Coating

  • Ceramic coating provides enhanced protection but does not make the vehicle immune to scratches, chips, or other damage.

  • SunKiss Auto Spa is not responsible for improper maintenance of the coating after application.

  4.4 Environmental Factors

  • We are not liable for any damage caused by environmental factors such as weather, road debris, or chemical spills after the service is completed.

 

5. Warranties and Guarantees

  • SunKiss Auto Spa does not offer warranties of any kind. No warranties are expressed or implied.

6. Health and Safety

  • For mobile detailing services, the Client must ensure that the service location is safe and free from hazards (e.g., aggressive pets, dangerous terrain, or lack of water/electricity if required).

  • SunKiss Auto Spa reserves the right to refuse or discontinue service if unsafe conditions exist.

 

7. Client Obligations

  • Clients must remove personal items from the vehicle prior to service. SunKiss Auto Spa is not responsible for lost, or damaged items.

  • Clients must ensure the vehicle is accessible at the scheduled time and location. Failure to do so may result in additional fees.

 

8. Limitation of Liability

To the fullest extent permitted by law, SunKiss Auto Spa shall not be liable for:

  • Any indirect, incidental, or consequential damages arising out of or related to our services.

  • The replacement cost of damaged materials, unless caused by gross negligence on our part.

  • Loss of use, profits, or data related to the vehicle.

 

9. Dispute Resolution

  • Any disputes or claims arising from our services will first be addressed through good faith negotiation. If unresolved, disputes will be settled through binding arbitration in Texas, Harris County, and both parties waive the right to a jury trial.

 

10. Privacy Policy

We respect your privacy and will not share your personal information with third parties except as required to provide services or comply with the law.

11. Intellectual Property

All content on our website, including text, images, logos, and service descriptions, is the intellectual property of SunKiss Auto Spa and may not be copied, distributed, or used without our express written consent.

 

12. Amendments

SunKiss Auto Spa reserves the right to modify these Terms and Conditions at any time. Updates will be posted on our website and will take effect immediately upon posting.

 

13. Governing Law

This Agreement shall be governed by the laws of the State of Texas.

 

14. Acknowledgment

By booking services with SunKiss Auto Spa, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
